1. Acceptance of Terms

By downloading, installing, accessing, or using the Aerogelsoftware, application, website, or interfaces (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). This is a legally binding contract between you (the user) and Aerogel.

If you do not agree to all of these Terms, you are strictly prohibited from using the Service and must immediately cease use, uninstall the application, and delete any associated local configurations.

2. Description of Service

Aerogel provides a software interface designed for "Truly Undetectable Real-Time AI" optimization, streaming, and generation. The Service acts as a multi-mode architectural conduit, enabling you to run AI execution entirely locally on your own hardware or connect to third-party artificial intelligence provider platforms through your own user-supplied API keys.

3. User Responsibility & Third-Party Providers

Aerogel is heavily focused on user autonomy. Therefore, your use of the Service is bound by the following structural rules regarding third-party platforms:

  • API Key Sovereignty: If you choose to use cloud-based providers (such as OpenAI, Anthropic, Groq, or others) within Aerogel, you must provide your own API keys. You are solely responsible for the safety, cost, and usage thresholds of those keys.
  • Third-Party Compliance: When routing requests through external providers, you agree to fully comply with their respective Terms of Service, developer policies, and generation guidelines. Aerogel is not responsible for any suspension, termination, or billing penalties incurred on your third-party accounts.
  • Pass-Through Nature: You acknowledge that Aerogel is an interface and middleware platform. We do not control, modify, filter, or log the data payloads traveling between your client and your selected AI provider.

4. License Grant & Restrictions

Subject to your adherence to these Terms, Aerogel grants you a personal, non-exclusive, non-transferable, revocable license to use the software on your designated personal or commercial devices.

You explicitly agree that you will not:

  • Reverse engineer, decompile, or attempt to extract the source code of proprietary binaries or core components of Aerogel unless permitted by underlying open-source licenses where applicable.
  • Use the Service to build a competing real-time AI interface with similar proprietary optimizations.
  • Sublicense, rent, lease, or commercially distribute the Aerogel software application without prior explicit written consent from the Aerogel operations team.

5. Prohibited Conduct & Content Responsibility

Because Aerogel does not collect, monitor, or review user data (as explicitly outlined in our Privacy Policy), we have no architectural mechanism to police what you generate. Consequently, **absolute legal responsibility for all outputs rests entirely on you.**

You agree not to utilize Aerogel to generate, process, or optimize content that:

  • Violates local, state, national, or international laws and regulations.
  • Facilitates or instructs on the creation of malware, weapons, or physical harm.
  • Infringes upon the intellectual property or copyright of any entity.
  • Acts to maliciously bypass critical safety filters implemented by underlying cloud providers in a manner that causes legal liability.

6. Intellectual Property

All branding, logos, trademarks, interface designs, codebase elements, and proprietary algorithmic optimizations uniquely developed by Aerogel remain the exclusive property of Aerogel. Your inputs, custom configurations, prompt libraries, and local model weights remain entirely your own.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Aerogel does not warrant that the Service will be completely uninterrupted, timely, secure, error-free, or that the generations provided by underlying AI models will be accurate, reliable, or free from hallucinations. You assume all operational risks associated with real-time software deployment on your infrastructure.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AEROGEL, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR INABILITY TO ACCESS OR USE THE SERVICE.
  • ANY CONDUCT, PROMPTS, OR CONTENT GENERATED BY THIRD-PARTY AI PROVIDERS.
  • ANY ISSUES STEMMING FROM EXPIRED, COMPROMISED, OR OVER-BILLED THIRD-PARTY API KEYS.

9. Termination

We reserve the right to terminate or suspend your software access licenses at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service immediately ceases.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of registration, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Modifications to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will post notice of the updated terms clearly on our platforms. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
